This page contains information about the delivery process for products purchased online or direct from TrustATrader, and related Terms and Conditions.
Delivery Process
- When you place an order the order confirmation will advise an estimated delivery date for the products in your order. You may receive separate order confirmations for products in your order dispatched separately. Dispatch times may vary according to supplier’s availability and delivery dates may be subject to postal delays. We will not be responsible for an event outside our control.
- Delivery costs will be calculated by us and will be specified as part of the order process before you place the order on the website. Delivery costs will be charged in addition to the price of the products. The estimated delivery date(s) will depend on the delivery service chosen.
- Delivery shall be via Royal Mail (or another non-trackable service).
- Delivery of an order shall be completed when we deliver the products to the address you provided to us (or tender delivery at that address). It is your responsibility to make arrangements to accept delivery on or a reasonable period after the estimated delivery time and the products will be your responsibility from the time of delivery (or tendered delivery). If a parcel is undelivered to a UK address after 14-21 days from the dispatch date we will consider issuing a refund after an investigation has taken place. Under no circumstances can we declare a parcel as lost until a full investigation has taken place.
- Although the Delivery Dates specified are for guidance only, if we miss the delivery date for any products for reasons within our control, then we will notify you as soon as possible, and will provide you with further reasonable delivery options (at no additional cost to you). You may cancel your order straight away if we notify you that we will not be able to make any further delivery of those product(s).
- If you do choose to cancel your order for late delivery under clause 5, you can do so for just some of the products or all of them. If the products have been delivered to you, you will have to return them to us complete with an authorised returns document issued by the sales dept. After you cancel your order we will refund any sums you have paid to us for the cancelled products that have been returned.
Terms and Conditions
These conditions form an integral part of every contract or agreement for the sale and/or supply of goods and/or services ('the products') by Trustatrader.com Ltd. Unless there are specific alterations or deletions agreed in writing on behalf of Trustatrader.com Ltd, these conditions shall apply in their entirety to all quotations made and all orders accepted on behalf of Trustatrader.com Ltd.
Except as provided above, no servant or agent of Trustatrader.com Ltd has any authority to vary these terms or accept other terms proposed by a Customer which are inconsistent with these conditions unless confirmed in writing.
Payment terms
- Payment for products can be made using a debit card or credit card which is approved by us.
- Payment for the products and all applicable delivery charges is due in Pounds Sterling in advance.
- Unless otherwise specifically stated the purchase price is deemed to include Value Added Tax and this will have been added where necessary. All prices quoted are liable to VAT, and will include VAT at the standard rate.
- Trustatrader.com Ltd reserve the right to suspend or terminate supply and lower credit limit in default of payments by Customer.
Delivery
- Trustatrader.com Ltd will endeavour to meet any delivery date quoted but delivery dates are given and intended as an estimate only and if there are any circumstances whatsoever which prevent or delay delivery, Trustatrader.com Ltd shall not be bound to supply or make delivery of any products ordered nor shall it be liable for any damage or consequential loss or in any other way for failure to supply or delay in delivery when so prevented or delayed.
- All products must be inspected immediately on arrival.
- All products supplied shall remain the property of Trustatrader.com Ltd until paid for in full.
- Any claim for short delivery must be notified to Trustatrader.com Ltd in writing, within 3 days of receipt.
- Claims for non-delivery must be made in writing, within 7 days of receipt of invoice.
- Trustatrader.com Ltd will not accept any products returned after 30 days from date of delivery.
- Trustatrader.com Ltd shall not be liable for any claim in respect of products decorated by the customer.
- The price list is intended as a guide only and is not an offer for sale. Trustatrader.com Ltd reserves the right to alter prices and specifications without prior notice.
- Delivery costs will be calculated by us and will be specified as part of the order process, which will be subject to change without prior notice. Next day or nominated day delivery shall be by a courier or other trackable service selected by us.
- Trustatrader.com Ltd is in no way responsible or liable for any indirect, or consequential loss, or for any loss to the customer arising from third party claims due to errors, defective dye, manufacturing or fabric faults, or any delay in delivery.
- Trustatrader.com Ltd shall not be liable in respect of any claims by the customer arising out of any of the conditions, warranties and guarantees subject to which the products are offered, as to all of which matters the customer shall satisfy himself.
- If any legislation is compulsorily applicable to any business undertaken, these terms and conditions shall, as regards such business, be read as subject to such legislation and nothing shall herein be constructed as a surrender by Trustatrader.com Ltd of any rights or immunities, whether as an increase of its responsibilities, or liabilities under such legislation and if any part of these terms and conditions be repugnant to such legislation to any extent such parts as regards such business be void only to that extent, but no further.
- Trustatrader.com Ltd does not give or imply any warranty that the products sold do not infringe the Patent rights of a third party. If products are manufactured to the customer's design, or according to the customer's instructions, the customer shall indemnify Trustatrader.com Ltd in respect of all claims, damages, costs and expenses in respect of any alleged infringement. On discovery of such infringement, the seller shall be at liberty to terminate the contract and receive payment of all products supplied, manufactured or allocated to the customer, even if not actually delivered to the customer.
- No agent, or employee of Trustatrader.com Ltd has the right to vary these terms and conditions, save that should any variation be agreed by Trustatrader.com Ltd at its absolute discretion then such variation should be approved, in writing, by a Director of Trustatrader.com Ltd.
- Unless specified on the contract, no guarantee is given or implied as to the quality, washing stability, colour-fastness, wearability, or making up quality of any products supplied, nor as to their fitness for any purpose expressed. The customer shall in no case be taken to have relied upon the skill or expertise of Trustatrader.com Ltd, or its agents.
- Every effort will be made to carry out the contract, but its due performance is subject to cancellation by Trustatrader.com Ltd, or to such variation as it finds necessary as a result of any Act of God, War, Strike, Lockout, or any other Dispute, Flood, Fire, Drought, Legislation, or other causes (whether of the foregoing class, or not) beyond Trustatrader.com Ltd’s control. No responsibility is accepted by Trustatrader.com Ltd for late deliveries.
- The construction, validity and performance of this contract shall be governed by the Laws of England and any legal proceedings in relation to such contract shall be submitted to the jurisdiction of the English Courts without prejudice to Trustatrader.com Ltd’s right to bring any such proceedings before the courts have jurisdiction in the place of residence and business.
- Products delivered to a third party, by the request of the customer, remain the risk of the customer.
- Trustatrader.com Ltd reserves the right to alter any specification without prior notice. Garment sizes and colours are for guidance only.
- All orders are subject to stock availability.
- This contract is divisible. Each delivery made shall be deemed to arise from a separate contract and shall be invoiced separately; any invoice for a delivery shall be payable in full in accordance with our terms of payment, without reference to and notwithstanding any defect of default in delivery of any other installment.
Returned products
- Trustatrader.com Ltd will not accept the return of products for any reason unless prior agreement been received from Trustatrader.com Ltd.
- All products being returned must be accompanied by an authorised returns document issued by the sales dept. Failure to do so will result in the consignment being rejected. Trustatrader.com Ltd will not be held responsible for any consequential loss as a result of this action.
- Products will only be accepted if returned in perfect condition and within 14 days of the original delivery, except where the condition is not perfect due to a manufacturer’s defect.
- Products with a manufacturer’s defect may be returned within 30 days of receipt of the parcel.
- Postage will not be refunded for products returned because they are not required.
- Discontinued & decorated garments will not be accepted.
Consent
When signing up for a web account, customers will have the option to Opt-In for marketing communications to be sent via email or the post. For existing customers wishing to Opt-Out of marketing communications, contact the Sales department.
Risk & Title
It is a condition of the contract that the property in all the products delivered by Trustatrader.Com Ltd to the Customer shall remain vested in Trustatrader.Com Ltd until Trustatrader.Com Ltd has received in cash or cleared funds payment in full for the products delivered and all products agreed to be sold by Trustatrader.Com Ltd to the Customer for which payment is then due.
Until payment due under all contracts between the Customer and Trustatrader.Com Ltd has been made in full the Customer shall hold the products upon trust for Trustatrader.Com Ltd.
Until such a time as the property in the products passes to the Customer, the Customer shall hold the products as the company's fiduciary agent and bailee and shall keep the products separate from those of the Customer and third parties and properly stored, protected and insured and identified as Trustatrader.Com Ltd’s property.
Notwithstanding that the property in all products to be delivered to the Customer by Trustatrader.Com Ltd shall remain vested in Trustatrader.Com Ltd until Trustatrader.Com Ltd has received payment in full, the risk of damage to or loss of all or any such products shall pass to the Customer forthwith upon delivery or deemed delivery thereof to the Customer and as from such date of delivery or deemed delivery the Customer shall be liable to pay Trustatrader.Com Ltd the contract price for such products whether or not the same are damaged or lost prior to this date that the property therein shall pass to the Customer.
Until such a time as legal title in the products passes to the Customer Trustatrader.Com Ltd may at any time require the Customer, its liquidator, (administrative) receiver or administrator to return the products and/or may repossess the products by entering upon any premises of the Customer or any third party where the products are reasonably believed to be stored.
Warranty
Save as is specifically set out herein Trustatrader.Com Ltd shall have no liability (however arising) in relation to any loss suffered by the Customer or any third party arising from the supply of the products (however caused).
If loss, damage or deterioration (other than for death or personal injury) is caused by Trustatrader.Com Ltd’s negligence, Trustatrader.Com Ltd ‘s liability shall be limited to the invoice value of the products.
Employees of Trustatrader.Com Ltd are not authorised to make oral representations as to the quality or fitness for any particular purpose of any products. If a representation is made or an opinion expressed orally which materially affects the Customer's decision to place an order for any products the Customer should ensure that such details are confirmed in writing by a duly authorised officer or employee of Trustatrader.Com Ltd so as to form a part of the contract, no liability can otherwise be accepted.
Trustatrader.Com Ltd shall not be liable to the Customer or be deemed to be in breach of contract by reason of any delay in performing or any failure to perform, and of Trustatrader.Com Ltd‘s obligations in relation to the products, if the delay or failure was due to any cause beyond Trustatrader.Com Ltd’s reasonable control.
Waiver
The rights of Trustatrader.Com Ltd shall not be prejudiced by any indulgence or forbearance extended by Trustatrader.Com Ltd to the Customer and no waiver by Trustatrader.Com Ltd in respect of any breach shall operate as a waiver in respect of any subsequent breach.
Jurisdiction
These conditions shall be governed by and construed in all respect in accordance with English Law.
